First Degree and Second Degree Burglary

In the state of Washington, burglary is divided into categories of first degree burglary and second degree burglary (RCW Chapter 9A.52).

Second degree burglary is defined as the act of entering or remaining in a building illegally with the intent of committing a crime against a person or property [RCW 9A.52.030]. First degree burglary is similar but involves a burglar who is armed with a deadly weapon or commits an assault (RCW 9A.52.020).

Both first and second degree burglary are serious charges that can result in jail time, probation, fines and additional criminal penalties. If you have been charged with burglary or any other felony criminal charge, contact an attorney immediately to protect your rights.
