Defending Against Drug Charges
Experienced criminal defense lawyers know many ways to defend clients charged with a drug crime. One possible defense in a drug crime is to make a motion seeking suppression of all evidence obtained in violation of a defendant's Fourth Amendment and rights under the US constitution and article 1 section 7 of the Washington State constitution.
The Fourth Amendment and article 1 section 7 protects your right to be free from unreasonable searches and seizures. Often, police seize drugs through the use of methods that violate the Fourth Amendment and article 1 section 7. Examples of Fourth Amendment and article 1 section 7 violations include searches conducted pursuant to search warrants lacking in probable cause, searches that exceed the scope of a warrant, illegally executed searches (e.g. failure to knock and announce) and body searches conducted without valid cause.
