First Degree and Second Degree Burglary

Under Washington law, a person may be charged with first or second degree robbery. I handle cases involving first degree and/or second degree robbery.

According to the Revised Code of Washington (RCW), a person commits robbery in the second degree when he or she unlawfully takes personal property from the person of another, against their will, by the use (or threatened use) of force, violence or fear of injury (RCW 9A.56.190 and 9A.56.210).

Robbery in the first degree is similar but requires an additional element. In addition to the elements of a second degree robbery, a person is guilty of first degree robbery if they inflict bodily injury or rob a financial institution or they are armed with a deadly weapon or they display what appears to be a deadly weapon (RCW 9A.56.200).
